1.1. This Privacy Policy describes how Omnyx Corporation ("we", "us", "our", "Company") collects, processes, stores and protects user ("User", "you" or "your") data when accessing and using Omnyx Wallet through the mobile application, website, and other interfaces provided by us (the "Platform").
1.2. Omnyx Wallet is a non-custodial wallet application. The Company does not store or have access to your Seed Phrase or private keys and does not custody Digital Assets. Digital Assets are recorded on Blockchain Networks and can be controlled only by the person who holds the corresponding private keys, which are stored on your device.
1.3. By accessing, browsing, registering or otherwise using the Platform operated by Omnyx Corporation, a company registered under the laws of the British Virgin Islands (registration number 2184082, registered office: Intershore Chambers, Road Town, Tortola, British Virgin Islands), you confirm that you are familiar with the purposes and methods of collection and processing data and agree to them.
1.4. The Company is aware of the importance of privacy and is committed to protecting your data. This Privacy Policy explains:
1.5. What data do we collect and why;
1.5.1. How we process and store data;
1.5.2. Your rights regarding the collected data;
1.5.3. In what cases and with whom we can share data.
1.6. If you do not agree to any of the terms set out in this document, please stop using the Platform.
For the purposes of applicable data protection laws, Omnyx Corporation is the "controller" of personal data processed under this Policy. If you have questions about this Policy or our privacy practices, you can contact us as described in Section 16 (Contact Information).
3.1.1. We follow the principle of data minimization. When using the Platform, we do not collect or process personal data within the meaning of personal data protection legislation (for example, name, email address, phone number, or payment details). We do not collect or store your Seed Phrase or private keys. To enable access to Blockchain Networks, the Platform may transmit public blockchain identifiers (such as Wallet addresses and Transaction data) to Blockchain Networks and to RPC access providers. The Company does not store such blockchain data on its own servers and does not link it to your real-world identity.
3.1.2. When using the Platform, we may collect and process only anonymous technical and behavioral data, including:
3.1.2.1. Device properties: type, model, operating system, application version, interface language.
3.1.2.2. System metrics: application launch time, download duration, technical errors and crash reports (crash logs).
3.1.2.3. Platform events: application launches, navigation between screens, button clicks, number of transactions on a particular network (excluding addresses and amounts).
3.1.2.4. Locally stored user settings: selected interface language, display currency, wallet name, account nickname, and user-generated notes on transactions or addresses.
3.2.1. Support communications: if you contact us (e.g., by email), we will receive the content of your message and any information you choose to provide, such as your email address and device details for troubleshooting.
3.2.2. Feedback and surveys: if you respond to surveys or provide feedback, we will process the information you submit.
3.2.3. Marketing subscriptions (if offered): if you subscribe to receive updates, we will process your email address to send those communications. You can unsubscribe at any time.
3.3.1. We receive data in the following ways:
3.3.1.1. App stores and operating systems: Apple (App Store) and Google (Google Play), as well as the mobile operating system provider, may process certain data in connection with installing, updating, and running the Platform. Such processing is governed by their own privacy policies and is outside the Company’s control.
3.3.1.2. Data provided by the User locally: selected interface settings (language, currency, wallet name, account nickname, comments on transactions or addresses, etc.). This data is stored exclusively on the User’s device and is not transmitted to us.
3.3.1.3. Anonymous technical metrics and events: automatically collected using built-in analytics tools. Such data includes behavioral events inside the application (for example, launching the application, navigating through screens, pressing buttons), device system parameters (type, model, operating system, application version), as well as event properties (for example, the number of transactions in a particular network without specifying addresses and amounts).
3.3.1.4. Crash and technical error reports: They are automatically generated in order to increase the stability of the application and improve the quality of work.
3.3.1.5. Access to blockchains: The Platform uses the infrastructure services of RPC access providers to request blockchain data and submit Transactions to Blockchain Networks. Such requests may include public blockchain identifiers (for example, Wallet addresses and Transaction data) and are limited to what is necessary for the Platform to function. They do not include your name, email address, or other direct identifiers. These providers process information under their own terms and policies. Where feasible, we strive to choose providers that support privacy-respecting practices, but we do not control how third parties process information you transmit to them.
3.4.1. To enable access to Blockchain Networks, the Platform must transmit and receive publicly-available blockchain data. This may include wallet addresses, transaction hashes, token contract addresses, and transaction metadata. Blockchain data is generally public by design, may be stored on distributed ledgers, and may be accessible to anyone.
3.4.2. We do not store your blockchain transaction history on our own servers as a user profile and we do not attempt to link your on-chain activity to your real-world identity. Nonetheless, wallet addresses and on-chain activity may be linkable to an individual by third parties (for example, through public records, analytics, or other data sources).
Some information is stored locally on your device and is not transmitted to us. This may include wallet names, account nicknames, selected language, display currency, and notes you create. Local storage may also include encrypted wallet data managed by your device security features.
4.1. The Platform may include integrations or links to Third-Party Services (for example, on-ramps, decentralized exchanges or aggregators, WalletConnect/dApps, or other providers) that are operated by independent third parties. When you choose to use such Third-Party Services, your requests, Transactions, and certain technical data may be processed by those third parties in accordance with their own privacy policies and terms.
4.2. The Company does not control Third-Party Services and does not receive, collect, or store any personal data that you may provide to them (for example, during KYC/AML checks or payment processing). You are responsible for reviewing the privacy policies and terms of any Third-Party Services before using them.
5.1. The data collected is used exclusively to ensure the stable operation, security, and continuous improvement of the Platform’s functionality.
5.2. The collected information is processed strictly for the following purposes:
5.2.1. Technical support and platform development: identifying and resolving errors, assisting Users in troubleshooting, enhancing the stability and performance of the application, and optimizing its overall operation.
5.2.2. Analysis of anonymous events and technical metrics: gaining insights into how Users interact with the Platform in order to further improve the interface and user experience.
5.2.3. Preservation of User preferences: storing interface language, display currency, wallet name, account nickname, and user-generated notes on transactions or addresses.
5.2.4. Responding to support requests and communication: addressing your inquiries and providing assistance.
5.2.5. Compliance with legal obligations: ensuring adherence to applicable laws and regulations.
5.3. All information processing activities are strictly limited to anonymous technical data required for the operation and improvement of the Platform. We do not sell your personal data and do not share it for cross-context behavioral advertising (targeted advertising) as those terms are defined under certain U.S. state privacy laws.
6.1.1. If you are located in the European Economic Area (EEA), the United Kingdom, or another jurisdiction requiring a lawful basis for processing personal data, we rely on one or more of the following legal bases depending on the context:
6.2. Performance of a contract: processing necessary to provide the Platform and related functionality you request in accordance with Terms of Use of the Platform.
6.3. Legitimate interests: processing necessary for our legitimate interests, such as securing and improving the Platform, preventing abuse, and operating our business, where such interests are not overridden by your rights.
6.4. Consent: where required, we will process certain data based on your consent (for example, optional analytics, or marketing communications). You may withdraw consent at any time.
6.5. Legal obligation: processing necessary to comply with applicable laws, lawful requests, and regulatory requirements.
7.1. We do not store Users’ personal data on the Platform. All information related to the use of the Platform - including private keys, seed phrases, and wallet settings - is stored exclusively on the User’s device and remains under their full control.
7.2. Only anonymous technical metrics and error reports are processed by the Company. Such data cannot be used to identify an individual User and is utilized solely to improve the quality, stability, and performance of the Platform.
7.3. Since all data related to the use of the Platform (including private keys, seed phrases, and wallet settings) is stored exclusively on the User’s device and is never transmitted to us, ensuring its protection is entirely the responsibility of the User. Please note that no digital system can guarantee absolute security; therefore, Users must independently apply appropriate measures to safeguard their devices and data.
7.4. We implement reasonable administrative, technical, and organizational measures designed to protect information we process. However, no system is completely secure. You are responsible for safeguarding your device, using strong device security controls, and protecting your Private keys.
7.5. Because Omnyx Wallet is non-custodial, we cannot recover your Private keys, freeze your assets, or reverse blockchain transactions. If your Private keys are compromised, you may lose access to your Digital Assets.
7.6. To enhance security, the Platform enables Users to apply additional protection methods on their devices, including:
7.6.1. Setting a password;
7.6.2. Biometric authentication (fingerprint, Face ID);
7.6.3. Graphic keys.
7.6.4. However, all such data is processed solely on your device and is not transferred to the Company.
8.1. The Platform may use technical cookies and similar technologies. These files are employed solely to ensure the proper functioning of the service and to store user preferences.
8.2. Cookies do not contain or transmit Users’ personal data to the Company. You can control cookies through your device and browser settings. If you reset the application data or uninstall the Platform, locally stored settings and preferences are removed from your device.
8.3. Some browsers offer a "Do Not Track" (DNT) signal. At this time, there is no industry-standard mechanism for honoring DNT signals across services, and our Platform may not respond to such signals.
9.1. We retain information only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. In general:
9.1.1. Diagnostics and crash logs are retained for a limited period necessary for troubleshooting and improving stability and may be aggregated or de-identified.
9.1.2. Analytics data (if enabled) may be retained for a limited period to understand trends and improve the Platform, and may be aggregated or de-identified.
9.1.3. Support communications are retained as needed to address your request and for reasonable follow-up and recordkeeping.
9.2. We may retain certain information for longer where needed to comply with legal obligations, resolve disputes, and enforce our agreements.
10.1.1. EEA/UK: Depending on your location and applicable law, you may have rights regarding your personal data, including the right to request access, correction, deletion, restriction, portability, and to object to certain processing. You may also withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority (for example, in the EEA or the UK) if you believe our processing of your personal data violates applicable law.
10.1.2. U.S. State Privacy Rights: If you are citizen of U.S., depending on your state of residence, you may have rights to know, access, correct, or delete certain personal information, and to opt out of certain types of processing (such as sale or sharing for targeted advertising). We do not sell personal data or share it for targeted advertising as described in this Policy.
10.1.3. Since the Company does not collect or store Users’ personal data, most of the standard rights related to personal data (such as the rights of access, rectification, and erasure) are not applicable in the traditional sense.
10.1.4. Users retain full control over their data because:
10.1.4.1. All private keys, seed phrases, and wallet settings are stored exclusively on the User’s device;
10.1.4.2. When you delete the app or log out of your account, the data is automatically deleted from the device;
10.1.4.3. The user can independently delete or change the local data at any time.
10.1.5. Users have the right to opt out of analytics collection (anonymous technical metrics and crash logs gathered through third-party services) by disabling the corresponding permissions in the device or application settings, where such functionality is available.
10.2.1. We do not engage in automated decision-making or profiling that produces legal or similarly significant effects about you based solely on automated processing.
The Platform is not intended for use by individuals under the age of 18 (or the age of majority in your jurisdiction). We do not knowingly collect personal data from children. If you believe, a child has provided personal data to us, contact us and we will take appropriate steps to address the issue.
12.1. The Company reserves the right to update or amend this Privacy Policy at any time in order to reflect changes in legal requirements, our data processing practices, or improvements to the Platform.
12.2. Users are solely responsible for regularly reviewing this Privacy Policy to remain informed of any updates or modifications. The Company does not provide individual notifications of such changes.
12.3. All changes take effect immediately upon publication of the updated version on the Website, unless otherwise stated. Continued use of the Platform following such changes constitutes acceptance of the revised Privacy Policy.
13.1.1. We may process information in countries other than your country of residence. Where required by applicable law, we implement appropriate safeguards for international transfers, such as contractual protections or other lawful transfer mechanisms.
14.1. This Privacy Policy shall be governed by, and construed in accordance with, the laws of the British Virgin Islands, without regard to conflict of law provisions.
15.1. In the event of any dispute, claim, or disagreement arising out of or in connection with this Privacy Policy, the parties shall first endeavor to resolve the matter amicably through negotiations.
15.2. If the dispute cannot be resolved through negotiations, it shall be submitted to the competent courts of the British Virgin Islands for final resolution, unless otherwise required by applicable law.
